    "You have to agree with me madam that society demands that if you kill someone, that there should be a harsh punishment."

    "I cannot dispute that but I would like to put it in context my lady. We cannot just have certain, we have to individualise, we have to look at circumstances."

    SOUNDBITE (English), Gerrie Nel, prosecutor:

    "If he doesn't have any funds it doesn't matter where he goes because he won't have the funds to pay the psychologist if he is at home, if he doesn't have the funds to pay if he was in prison, am I right?"

    "That is correct concerning psychological treatment."

    SOUNDBITE (English), Gerrie Nel, prosecutor:

    "But then the court can do him a favour by sentencing him to prison because it's free, and it's available, because in prisons we have that."

    "That is correct my lady but I am not sure that it is going to be a favour."
