Brawl rumours shouldn't influence Pistorius case, says law attorney

  • Intro:

Oscar Pistorius on Tuesday was reportedly been involved in nightclub argument.

    Script:

SOUNDBITE (English) Llewelyn Curlewis, criminal law attorney:

"The judge is not supposed to listen to gossip or even supposed to read about, what happened in a newspaper with accused that appears in front of her. So one would like to think that she would remain objective, not be influenced in any way whatsoever by the latest developments. And then obviously this is not an issue to deliberate or to make a judgement call on, also implies that from a legal perspective I don't think judge (Thokozile) Masipa, will make too much about it."

SOUNDBITE (English) Llewelyn Curlewis, criminal law attorney:

"So the latest developments won't per se have an influence on that case. Unless Gerrie Nel is adamant that it has an implication on Oscar Pistorius bail conditions and then it boils down to contravention of one or two of those. Because look, as an ordinary and a general requirement you are not allowed to participate or get involved in altercations and quarrels and misconduct and crime whilst you are out on bail. And that implies that the state is strictly speaking, entitled to evoke his bail."
