ASKS FOR PABLO RUZ TO BE REPLACED - Rosell wants judge from Barcelona

This Monday, Sandro Rosell's lawyer, Ignacio Ayala made a formal request for a ruling against the judge in the 'Neymar Case' in the National Court, Pablo Ruz, for a lack of legal competence.

The request is based on the fact that the alleged tax fraud and the company law offence Rosell has been charged with took place in Barcelona. Furthermore, the former president's lawyers state that the aggrieved party is FC Barcelona, and therefore once again ask that the case be transferred to the Catalonian city.

Their request omits the fact that the crime they are charged with occurred outside Spain, allegedly committed by a Spanish club, which means the case should be dealt by the National Court. Both the signing of the contract, which took place in Sao Paulo, and the effective "consummation" of the alleged offence took place in Brazil. The exact moment the money was deposited in the account of Neymar's Father (N&N) is a key factor in the case hearing the charges Rosell is facing, putting it within the direct jurisdiction of the National Court.

This is not the first time they have made this request, as it was argued at the case's inception. It is highly unlikely that Judge Pablo Ruz will be declared as lacking legal competence at this stage of the case when the request was previously referred for consideration. Sources involved in the case have told MARCA that this is more to do with delaying tactics where the time spent on it favours the defendants. Ruz will have to leave his position at the National Court shortly and the case being put back a few months could also relieve Barcelona's presidential elections from the case.
